CC&R / Bylaws Change Vote

The results of the mail balloting, which was scheduled to be closed on October 9, 2000, but was held open for several days in an attempt collect the necessary vote, are shown below. These results were finally published in the Courier in early December 2000.

Proposed Restated CC&Rs

397 owners voted FOR the proposal (54% of all owners)

53 owners voted AGAINST the proposal (7% of all owners)

289 owners did not vote

The requirement for adoption was 75% of the elligible voters. The Association Board subsequently successfully petitioned the Superior Court to reduce the required vote on the basis that they were unable to obtain adequate member participation in an election to achieve the required percentage. The reduced adoption percentage was approved on January 25, 2001, and the Revised CC&R's became effective on February 23, 2001 following distribution to the membership.


Proposed Restated Bylaws

400 owners voted FOR the revised Bylaws (54% of all owners)

46 owners voted AGAINST the revised Bylaws (6% of all owners)



The vote on the Restated Bylaws passed and the Bylaws became effective on February 23, 2001 when they were distributed with the New CC&R's.
