The Rockpointe Homeowners Association Board of Directors held a meeting on December 15, 1999, to ratify the election and install the newly elected Board Members.

In accordance with the primary guidance received from the Legal Council employed to Audit the Election and assist with procedural issues, the Board declared the election as follows:

  1. The first, second, third, and fifth place candidates were elected as announced at the Adjourned General Meeting.

  2. The individual who received the fourth greatest number of votes (Mr. Erath) was declared as an invalid nominee and disqualified.

  3. The candidate who received the sixth greatest number of votes (Mr. Hull) was declared as elected to the fifth seat up for election.

In accordance with a previously negotiated agreement, Mr. Hull then resigned from his elected seat and the Board used their authority to APPOINT Mr. Erath to the open Board position.

In my opinion, the Board should be commended for their action and cooperative attitude in this matter. The action taken should be considered a Win - Win result. The legal requirement for nominations from the Nominating Committee or a Homeowner of Record was satisfied, and the individual who received the votes required to give him a seat on the Board was seated. The demonstrated will of the Homeowners was achieved.


NOTE: I am out of state this week and unfortunately was unable to attend the December 15th Board Meeting in person. This report is based upon second hand information that I believe is reliable, but if anyone is aware of any errors please bring them to my attention so they may be corrected.   Jim Fortney
